We're Moving......

After 17 years at the Shops of Harper's Point, our Symmes Twp. office of RE/MAX Unlimited Realtors is moving.
Having more than 100 real estate agents and staff and looking to expand to 140+ agents, it was time to find more office space.
Our new office location is at 7870 East Kemper Rd, about 1.5 miles west of Montgomery Rd and about 1.5 miles east of Reed Hartman Hwy (next to the Kids First Sports Center). We're on the first floor of the brand new, 4-story office building and we'll have 3/4 of the first floor space when everything is completed.
We will be open for business on Tuesday, January 2, 2006.

Melting Snow, Bad Coughs & Holiday Cheer

As the snow is almost melted and Santa has come and gone, we at the Weis' have had a great holiday so far, even though our daughter, Amanda, has been sick with a fever and has been constantly coughing the past few days. Our doctor gave her some medicine that seems to be starting to work. Amanda had her last day of school last Wednesday and is very sad, because her favorite student teacher, Miss Fordyce, will be going back to Miami (Ohio) to finish her teaching degree. For the past several weeks, she starts crying at the drop of a hat, because Miss Fordyce won't be there after Christmas. Our son, Bryan, loves playing his video games and starts playing games in the Upward Basketball League in two weeks. My wife, Amy, loves the holidays, because she decorates our home in a festive atmosphere and bakes cookies and bakes and bakes more cookies. As for me, this time of year allows me to take a brief breather and take time to reflect. I also plan out my personal and business goals for the coming year. It's been a great time re-connect with family and friends. I hope you are enjoying this holiday season too.

"Get Out Of Dodge" Pack

What's a "Get Out Of Dodge" pack, you ask?

Well, this is an idea that my favorite financial planner, Marjorie Falk, recently shared with me.

What would you do if an impending disaster was upon you and your property? What would you need to take with you and what would you leave behind? Just in case, you need to prepare for a tornado, flooding, fire or other natural disaster.

Here are a few tips to think about:

  • Who would you call?
  • Where would you go?
  • How would you keep in touch with family and friends?
  • Do you have a copy of your homeowner's insurance, social security card, and extra cash?
  • Do you have all of your important documents in a safe deposit box?
  • Do you have a flashlight, radio, extra batteries, water and non-perishables ready in a box?

You may also want to go through your home and take digital photos of everything for insurance purposes, so that if you need to leave in a hurry, you won't panic about what you're leaving behind. Also, make a location list of important items that you'd want to take with you, so you won't forget.

How To Get What You Want In Life

I recently read a true story about how one's life can change......
"One stormy night many years ago, an elderly man and his wife entered the lobby of a small hotel in Philadelphia. Trying to get out of the rain, the couple approached the front desk hoping to get some shelter for the night. "Could you possibly give us a room here?" the husband asked.
The clerk, a friendly man with a winning smile, looked at the couple and explained that there were three conventions in town. "All of our rooms are taken," the clerk said. "But I can't send a nice couple like you out into the rain at one o'clock in the morning. Would you perhaps be willing to sleep in my room? It's not exactly a suite, but it will be good enough to make you folks comfortable for the night." When the couple declined, the young man pressed on. "Don't worry about me. I'll make out just fine," the clerk told them. So the couple agreed.
As he paid his bill the next morning, the elderly man said to the clerk, "You are the kind of manager who should be the boss of the best hotel in the United States. Maybe someday I'll build one for you." The clerk looked at them and smiled. The three of them had a good laugh. As they drove away, the elderly couple agreed that the helpful clerk was indeed exceptional, as finding people who are both friendly and helpful isn't easy.
Two years passed. The clerk had all but forgotten the incident when he received a letter from the old man. It recalled that stormy night and enclosed a round-trip ticket to New York, asking the young man to pay them a visit. The old man met him in New York, and led him to the corner of Fifth Avenue and 34th Street. He then pointed to a great, new building there, a palace of reddish stone, with turrets and watchtowers thrusting up to the sky. "That," said the older man, "is the hotel I have just build for you to manage." "You must be joking," the young man said. "I can assure you I am not," said the older man, a sly smile playing around his mouth. The older man's name was William Waldorf Astor, and the magnificent structure was the original Waldorf-Astoria Hotel.
The young clerk who became its first manager was George C. Boldt. The young clerk never foresaw the turn of events that would lead him to become the manager of one of the world's most glamorous hotels.'

Realtor Code of Ethics Change May Put Buyers At Disadvantage

In October, the National Association of Realtors' Board of Directors voted to amend three of the Standards of Practice that clarify what is required of Realtors to comply with the NAR Code of Ethics.

Now you may be thinking what does this have to do with anyone planning to buy a home?

Well, one of the three changes may cause a home buyer to be at a major disadvantage when it's time to make an offer on a property.

The significant change involves Standard of Practice 1-13. This standard sets forth a Realtor's duty make certain disclosures when a Realtor enters into an agreement to represent a buyer.

Effective January 1, 2006, buyer's agents will be required to advise their clients of the possibility that the seller, or listing agent, may not treat the existence, terms or conditions of their offer as confidential.

Such confidentiality is not required of sellers under Ohio law and would only be required of a listing agent when they function as a dual agent for the seller and buyer. When a listing agent only represents the seller, they only owe a duty of confidentiality to the seller and no such duty to the buyer. This would mean that a seller could direct their agent to disclose the existence of an offer and the terms or conditions contained in that offer to competing buyers. The listing agent would have to follow those instructions, because of their fiduciary duty to obey the lawful instructions of their client.

Unfortunately, most buyers are under the misconception that the terms of an offer to purchase they make are confidential and will not be revealed to other buyers. The purpose of the amendment is to assure that buyer's agents are advising their clients of this fact.

Such advice can be done verbally or in writing. Further, buyers who want to make sure their offers are not revealed to others or "shopped" could negotiate a confidentiality agreement with the seller. This would need to be done in advance of submitting an offer.

Since this is brand new and may cause some confusion in the marketplace, please make sure to share this information with any family or friends, who plan on purchasing a home in the near future. I am also available to help answer any questions on this issue.
